Blog No.5 Data Privacy Act of 2012

1. Do you think the Data Privacy Act of 2012 does not violate our freedom of speech and freedom of expression? Explain your answer. 

  • I think for me Data Privacy Act of 2012 is not violating our freedom of speech and freedom of expression simply because this act help us from the people who has intention to hack our personal data or our privacy. If there is a person who hack your personal information or your privacy the law will provides him/her a separate penalties for various violation from what he/she did, most of which also include 5 years of imprisonment and a fine of approximately 500,000 – 1,000,000 pesos. That’s why this act is not violating us because the main reason or intention of this act is to protect our privacy.

2. Among the rights of a Data Subject, which do you consider as the two (2) most important rights? Why? Elaborate your answer. 

  • For me I will consider most important rights of a Data Subject which stated in Republic Act 10173 Chapter IV Sec. 16 Rights of the Data Subject are the Sec. 16  (a) Be informed whether personal information pertaining to him or her shall be, are being or have been processed; and Sec 16 (5) Methods utilized for automated access, if the same is allowed by the data subject, and the extent to which such access is authorized; because every person has the right to be inform first about him/her personal data use before any processing data occurs. Secondly , the person has the right to have an authorization of his/ her personal data.

3. In Data Privacy Act of 2012, when do you consider a person as a Data Subject? Provide an example situation.

  • I will consider a person to be a Data Subject in a scenario of a person medical information because every person may not wish for their medical records to be revealed to others. This may be because they have concern that it might affect their insurance coverage or employment. Or, it may be because they would not wish for others to know about any medical or psychological conditions or treatments that would bring embarrassment upon themselves. Revealing medical data could also reveal other details about one’s personal life.
